Terms of Service for EEVA Store

Overview

This website is operated by Elegance EV Accessories Pty Ltd (ABN 48 689 265 923), trading as EEVA Store. Throughout the site, the terms "we," "us," and "our" refer to EEVA Store. By accessing or using this website, you agree to be bound by these Terms of Service ("Terms"), including any policies referenced on our Site. If you do not agree to these Terms, you may not use the site or our services.

Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).

Section 1 – Online Store Terms

By agreeing to these Terms, you confirm that you are at least the age of majority in your jurisdiction or have given consent for your minor dependents to use this site. You may not use our products for unlawful purposes or violate any laws.

Section 2 – General Conditions

We reserve the right to refuse service to anyone for any reason at any time, to the extent permitted by law.

Your information may be transmitted over networks and handled by third-party service providers we use to operate our store, such as Shopify, payment providers, fulfilment partners and delivery providers. We take reasonable steps to protect your information, however no method of transmission or storage is completely secure.

Section 3 – Accuracy, Completeness, and Timeliness of Information

We aim to keep information on our Site accurate and up to date, but we do not guarantee it is always complete, current or error-free. Information on the Site is general and should be considered together with product descriptions and your own requirements.

Section 4 – Pricing and Orders

  • Prices may change without notice. We take reasonable care to ensure pricing is accurate at the time of publishing.
  • If a product is listed at an incorrect price due to an error, we may cancel the order and provide a full refund.
  • We may cancel an order if an item is out of stock, cannot be supplied, has been discontinued, or where we reasonably suspect fraud or unauthorised activity. If we cancel your order, we will notify you and refund any amounts paid.
  • Receipt of an order confirmation email does not mean the order has been accepted for dispatch. Orders are accepted once processed and dispatched by us or our fulfilment partners.

These Terms are intended to operate consistently with the ACL.

Section 5 – Modifications to the Service and Prices

We may update, modify or discontinue products or services from time to time. Where required by law, we will provide refunds or remedies in line with the ACL.

Section 6 – Products or Services

Some products may be available only online and in limited quantities. Colours, finishes and designs may vary slightly depending on your device, display settings, production batch, or fulfilment source.

Please read product descriptions carefully to confirm vehicle compatibility, model notes, and variant selection. If you're unsure, contact us before ordering.

Some product photos are for illustration only. For certain items, the exact shape, cut, finish, packaging, or fit may vary depending on vehicle configuration, model year, trim, supplier batch, or fulfilment source.

Section 7 – Shipping and Delivery

Delivery timeframes provided are estimates only and may vary due to factors outside our control, including supplier delays, carrier delays, customs delays, weather events, and peak periods.

Some items may be offered as pre-orders. Pre-order dates and ETAs are estimates only and may change.

Some items may be shipped directly from suppliers, including overseas suppliers, and some orders may be shipped in multiple parcels. Packaging and tracking formats may differ between shipments.

You are responsible for providing a complete and correct delivery address.

For security reasons, if you need to update your address after ordering, we may require you to update it within your account profile before we can sync and process the updated details.

Section 8 – Refunds and Returns

Our Refund and Return Policy, available on our Site, outlines our process for returns, exchanges, and refunds. It does not limit your rights under the ACL.

For change-of-mind and compatibility returns, returns may be accepted only if the item is unused, undamaged, in original packaging, and in resellable condition. Return shipping, handling, and any applicable restocking or return handling fee may be deducted from the refund, as set out in our Refund and Return Policy.

Section 9 – Accuracy of Billing and Account Information

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. We may cancel or refuse any order where permitted by law and will notify you if that happens.

Section 10 – Optional Tools

We may provide access to third-party tools or services that we do not control. These are provided "as is" and "as available" and you use them at your own discretion.

Section 11 – Third-Party Links

Our Site may include links to third-party websites. We are not responsible for the content, policies or practices of third parties.

We may correct errors, inaccuracies or omissions, including product descriptions, pricing, promotions, shipping charges, compatibility notes, images, and availability, and may cancel or amend orders affected by such issues where permitted by law.

We do not guarantee that the Site will be error-free or uninterrupted at all times.

To the fullest extent permitted by law, our liability for any loss or damage is limited to the minimum remedies required under the ACL and other applicable laws. This clause does not exclude or limit consumer guarantees that cannot be excluded under the ACL.

Section 16 – Indemnification

You agree to indemnify and hold harmless EEVA Store and its officers, employees and affiliates from claims, losses, damages and expenses arising from your breach of these Terms or unlawful use of the Site, to the extent permitted by law.

Section 17 – Severability

If any provision is found unlawful or unenforceable, that portion will be severed, and the remainder will remain valid.

Section 18 – Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and Australia.

Section 19 – Entire Agreement

These Terms, together with our Refund and Return Policy, Shipping Policy and Privacy Policy, constitute the entire agreement between you and us regarding your use of the Site and purchases from EEVA Store.

Section 20 – Changes to Terms of Service

We may update these Terms from time to time. Continued use of the Site means you accept the latest version.
